Clarification Text on Personal Data Processing

The extent to which your personal data can be processed by Toplum Çalışmaları Derneği as a “Data Officer” is explained below. Your personal data is processed by the Data Officer within the framework described below and always in accordance with the Personal Data Protection Law No. 6698 (“Law”). Toplum Çalışmaları Derneği (“TÇD”) shows maximum sensitivity to the security of personal data. The scope of processing your personal data by TÇD is explained in detail below.
  1. Collection Methods of Personal Data and Purposes of Processing
Collection methods of personal data and legal reasons: Your personal data is collected by TÇD in physical or electronic environment upon your declarations and within the framework of the relationship between TÇD and you. In this context, your personal data is collected through the databases of various institutions and organizations, depending on the service provided by TÇD, to the extent permitted by the relevant legislation and agreements and within the limits drawn, by obtaining your consent when legally required. TÇD collects the personal data of applicants who sent their CVs to “info@toplum.org.tr” e-mail address with their explicit consent during recruitment process, answer the questions asked during the interview with their consent, or by utilizing CV viewing methods of human resources software programs (such as Kariyer.net, LinkedIn, etc.) rendering candidate pool and publishing announcement services. Your personal data collected through these methods are processed within the scope of the personal data processing conditions and purposes specified in the 4th, 5th and 6th articles of the Law No. 6698. Personal Data will be processed for:
  1. Providing the requested services,
  2. Planning both legal and business strategies,
  3. Evaluation of candidates in recruitment processes
  4. Providing information to the Authorized Court, Enforcement Office, relevant institutions and/or organizations,
  5. Giving information about developments in the field of law and legal legislation updates,
  6. Execution of contract processes and determination and control of the signatory powers of the parties signing the relevant documents
  7. Registration of identity, address, tax number and other information necessary for the identification of the owners and persons concerned of all kinds of business and transactions, and their arrangement on paper or electronically,
  8. Managing client relations,
  9. Execution and/or performance of a legal consultancy contract,
  10. Execution of information security process,
  11. Preparation of client meetings held in our law firm, consultancy offers, legal reports and examination of offers for other legal services,
  1. To Whom Personal Data May Be Transferred And For What Purposes
Your personal data collected by TÇD will be transferred to 3rd parties within the scope of the personal data processing conditions specified in the 5th and 6th articles of the Law on the Protection of Personal Data No. 6698 and limited to the purposes specified in this document and in accordance with the 8th and 9th articles of the Law on the Protection of Personal Data. These persons and Institutions are TÇD’s business partners, lawyers and authorized courts and/or enforcement offices and public institutions and organizations. In addition, your data can be sent directly or indirectly within the framework of personal data processing conditions and purposes specified by TÇD to third parties from whom it receives or plans to receive consultancy, support or legal services abroad, third parties from which it receives or plans to receive consultancy support or service in other matters, legally authorized institutions and organizations. All measures regarding the transfer of this data are taken by TÇD. In addition, a commitment is taken that the third parties who transfer data also take the necessary technical and administrative measures. Data can be transferred to data processing infrastructures, cloud computing systems in order to realize the purposes of this text by taking the necessary security and legal measures, and can be archived in electronic or physical environments in order to fulfill legal obligations.
  1. Rights of Data Owners and Exercising These Rights
Your personal data may be collected in all kinds of written, verbal and electronic media for the purposes listed in the 1st article of this clarification text. Your personal data collected through these methods can also be processed and transferred for the purposes specified in articles (b) and (c) of this Information within the scope of the personal data processing conditions and purposes specified in Articles 5 and 6 of the Law No. 6698. As personal data owners, if you submit your requests regarding your rights stated below to TÇD using the methods specified under the heading of Exercise of Rights by Data Owners, your requests will be evaluated and finalized by TÇD as soon as possible and in any case within 30 (thirty) days.

  1. Learning if your personal data has been processed,
  2. Requesting information regarding the personal data if they are processed,
  3. Learning the purpose of his data processing and whether this data is used for intended purposes,
  4. Knowing the third parties to whom your personal data has been transferred inside or outside the country,
  5. In case your personal data is incomplete or inaccurately processed, requesting that these be corrected and requesting that the transactions made within this scope be notified to third parties where your personal data is transferred,
  6. Requesting deletion or disposal of personal data in case the reasons that require processing have been eliminated despite the fact that it has been processed in accordance with the Law on PDP and other relevant legal provisions and requesting notification to the third parties to whom personal data has been transferred,
  7. Making an objection in case there comes a disadvantageous result after analyzing the processed data exclusively by means of automated systems,
  8. Claiming damages if you incur losses due to unlawful processing of your personal data.
  1. Exercise of Rights by Data Owners
You can forward your requests regarding the above-mentioned rights via the registered e-mail address of  info@toplum.org.tr. In cases where the conclusion of the aforementioned requests also requires a fee, TÇD may charge the applicant the fee in the tariff determined by the Personal Data Protection Board.
